Participant Waiver

I fully understand that my participation in the September 11 Memorial Climb (hereinafter “event/class”) exposes me to the risk of personal injury, death, or property damage. I hereby acknowledge that I am voluntarily participating in this event and agree to assume any such risks.

I hereby release, discharge and agree not to sue the Ventura City Honor Guard and/or The City of San Buenaventura, its officials, officers, agents, employees and volunteers for any injury, death or damage to or loss of personal property arising out of, or in connection with, my participation in the event/class from whatever cause, including the active or passive negligence of the Ventura City Honor Guard and/or The City of San Buenaventura, its officials, officers, agents, employees and volunteers or any other participants in the event/class.

In consideration for being permitted to participate in the event, I hereby agree, for myself, my heirs, administrators, executors, and assigns, that I shall indemnify and hold harmless the Ventura City Honor Guard and The City of San Buenaventura, its officials, officers, agents, employees, and volunteers from any and all claims, demands actions or suits arising out of or in connection with my participation in the event.

I HAVE CAREFULLY READ THIS RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN ON MY OWN FREE WILL.

WAIVER AND RELEASE OF LIABILITY - VENTURA FIRE FOUNDATION

NOTE: THIS FORM MUST BE READ AND ACKNOWLEDGED BEFORE THE PARTICIPANT IS PERMITTED TO TAKE PART IN ANY FUNCTION – BY CHECKING THE BOX, THE PARTICIPANT AFFIRMS HAVING READ AND UNDERSTOOD IT AND IS IN AGREEMENT WITH ITS CONTENTS.

In consideration of my involvement in the activities under the auspices of Ventura Fire Foundation, I acknowledge, appreciate and agree that:

1. I risk bodily injury, including paralysis, dismemberment, disability and death, and this risk of injury does exist as well as the risk of damage to or loss of property.
2. I knowingly and freely assume all such risks; both known and unknown, even if arising from the negligence of the releases or others.
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual or unnecessary hazard during my presence or participation, I will bring such to the attention of the nearest official immediately; and,
4. I, for myself, and on behalf of my heirs, assignees, personal representatives, and next of kin, hereby release, hold harmless and promise not to sue Ventura Fire Foundation their officers, volunteers, staff,
   sponsor, and/or agents with respect to any and all injury and/or loss arising from my participation, whether caused by the negligence of the releases or otherwise, except that which is the result of gross negligence or wonton misconduct, to the fullest extent permitted by the state of California. The laws of the state of California, exclusive of its choice of law rules, shall apply to this waiver and release of liability agreement.

I have read this Release of Liability and Waiver Agreement, fully understand its terms, understand that I have given up substantial rights by acknowledging it, and acknowledge it freely and voluntarily without any inducement.

PHOTO AND IMAGE RELEASE

I hereby grant permission to Ventura Fire Foundation, the City of Ventura, and the 9-11 Memorial Stair Climb sponsors to use photographs and/or video of me taken on 9-7-24 at the 9-11 Memorial Stair Climb in publications, news releases, online, and in other communications.
